Amendment to Complaint and Request for Status Conference

Our legal team has filed an amended complaint to add the appointed commissioners as defendants and have them ousted from office through a writ of quo warranto, based on the public’s interest:

The revised complaint includes a new claim asking the court to declare the appointment of a supermajority of commissioners to an elected body as unconstitutional. We have also requested a status conference to expedite the court’s decision and find a clear path forward given the time sensitivities:

We appreciate the work of our attorneys Jane Graham, Andy Bardos, and Ashley Lukis and are hopeful for a speedy resolution to this case.

Meanwhile, the Commission is scheduled to discuss our settlement offer at an executive session Tuesday, February 6th. We will let you know any updates from the City regarding this discussion.
